Terms of Service for GigTaxHelper
1. Acceptance of Terms
By downloading, installing, or using GigTaxHelper (the "App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.
2. Description of Service
GigTaxHelper is a financial tracking tool designed for gig workers to record income, track mileage, estimate tax obligations, and access related features. The App provides estimates and informational content only and does not constitute professional financial, tax, or legal advice.
3. Eligibility
You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the App.
4. User Accounts and Registration
To access certain features, you may be required to provide an email address and create a user profile. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your device and account
- Notify us of any unauthorized use of your account
5. Subscriptions and Payments
Some features require a paid subscription ("Pro"). Payments are processed exclusively through the Apple App Store and Google Play Store. Subscription terms, including pricing and renewal, are governed by the applicable store's terms.
- Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period
- You can manage and cancel subscriptions in your App Store or Google Play account settings
- Refunds are handled by the app store in accordance with their policies
6. Free Trial
We may offer a free trial period for Pro features. At the end of the trial period, the subscription will automatically convert to a paid subscription unless canceled before the trial ends.
7. Privacy
Your use of the App is also governed by our Privacy Policy, available at Privacy Policy.
8. License and Restrictions
We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial use. You agree not to:
- Modify, reverse engineer, or create derivative works of the App
- Use the App for any illegal or unauthorized purpose
- Attempt to interfere with the App's operation or security
- Use the App to violate any applicable laws or regulations
9. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or secure. All tax, financial, and mileage calculations are estimates and should not be relied upon as professional advice.
10. Limitation of Liability
To the maximum extent permitted by law, 400K shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. This includes, but is not limited to, tax filing errors, lost income, or financial losses resulting from reliance on App-generated estimates.
11. Intellectual Property
All intellectual property rights in the App, including but not limited to the code, design, branding, and content, are owned by 400K. You may not use our trademarks or branding without prior written consent.
12. Third-Party Services, APIs, and External Libraries
The App integrates with and relies on various third-party services, official government APIs, and open-source libraries to deliver core functionalities such as automated fuel pricing, mapping, mileage logging, local weather updates, authentication, analytics, and tax report generation. You acknowledge and agree to the following integrations:
A. Third-Party & Government API Integrations:
- U.S. Energy Information Administration (EIA) API: Provides automated, real-time weekly regional fuel and gasoline price structures.
- TomTom Maps & Traffic API: Powers precision location services, mileage logging, route analysis, and traffic monitoring.
- National Weather Service (Weather.gov) API: Delivers localized, real-time public weather data to optimize driving and shift safety.
- Resend API: Used as a secure transactional email infrastructure to handle authentication and communication for premium ("Pro") users.
- Apple App Store & Google Play Store: Manages secure "Pro" subscription processing, billing, and transactional operations.
- Google Apis & Auth Libraries: Used for Google Play Developer ecosystem communication and user profile verification.
B. Open-Source Software & NuGet Libraries:
The App utilizes several open-source packages under their respective author licenses (including MIT, Apache 2.0, and BSD). By using the App, you agree to comply with the limitation of liability clauses governing these packages:
- Microsoft Entity Framework Core (EF Core) & SQLite: Powers local on-device secure data storage and encrypted database operations.
- CommunityToolkit.Maui & CommunityToolkit.Mvvm: Manages native UI components, architectures, and performance optimization.
- ClosedXML & SharpZipLib: Handles high-performance compilation, styling, and secure zip compression of Excel/CSV tax report exports.
- SixLabors.ImageSharp: Manages internal asset optimization and image processing layouts.
- Xamarin.Google.MLKit.TextRecognition: Powers the local AI-driven receipt, expense, and text scanning functionalities on Android.
- Xamarin.AndroidX Ecosystem (Lifecycle, LiveData, ViewModel, Work.Runtime): Optimizes native Android background processes, state maintenance, and battery-efficient logging.
We do not own, control, or assume any responsibility for the uptime, operational practices, changes, or privacy behaviors of these external third-party service providers.
13. Tax Calculations, Mileage Rates, Fuel Prices, and Financial Estimates Disclaimer
GigTaxHelper contains an internal proprietary TaxService engine that performs automated financial estimations. You explicitly acknowledge and agree to the following operational boundaries:
- Internal Logic & Rates: The App utilizes hardcoded statutory estimates based on federal projections, including the 2026 standard IRS mileage rate (set at $0.67 per mile), standard Self-Employment Tax rates (15.3%), and individualized multi-state tax brackets (including but not limited to progressive or flat calculations for NY, CA, FL, TX, PA, IL, NJ, and other jurisdictions).
- Estimates Only: All outcomes, including Mileage Deductions, Self-Employment Taxes, Federal Income Taxes, and State Tax Liabilities, are strictly computational models and informational estimates. They do not constitute formal tax filings or legal declarations.
- Fuel Price Estimates: The App may display automated fuel price estimates obtained from third-party API sources (e.g., U.S. Energy Information Administration). These prices are for reference only and may not reflect the actual price you paid. You are solely responsible for entering your actual fuel costs. The developer and company shall not be held liable for any financial discrepancies, losses, or damages arising from reliance on automated fuel price estimates within the App.
- User Responsibility: You are solely responsible for inputting accurate business mileage percentages, verifying your filing status (Single, Married, Head of Household), auditing the software’s outputs, entering correct fuel prices, and consulting with a Certified Public Accountant (CPA) or licensed financial advisor before submitting any returns to the IRS or State Departments of Taxation.
14. Termination
We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, third parties, or us.
15. Changes to Terms
We may update these Terms of Service from time to time. Continued use of the App after changes constitutes acceptance of the revised terms.
16. Governing Law
These Terms shall be governed by the laws of the State of New York, United States, without regard to its conflict of law provisions.
